01About These Terms

These Terms of Service ("Terms") govern your use of the Festival OS platform, including its public intake forms, attendee application, and public lineup page (collectively, the "Service"). By using the Service you agree to these Terms.

The Service is operated by the festival organiser ABN [placeholder] ("we", "us", "our"), based in New South Wales, Australia.

02Who May Use the Service

You must be at least 18 years old to submit an application. If you are under 18, a parent or guardian must submit on your behalf. By using the Service you confirm that you meet this requirement or have obtained the necessary parental consent.

03Acceptable Use

When using the Service you agree not to:

  • Submit false, misleading, or fraudulent information in any application
  • Impersonate another person or organisation
  • Upload content that is unlawful, harmful, abusive, or infringes any third-party rights
  • Attempt to gain unauthorised access to any part of the platform
  • Use automated tools to scrape or submit data without our written consent
  • Interfere with or disrupt the operation of the Service

04Applications and Selection

Submitting an application does not guarantee acceptance. We reserve the right to accept or decline any application at our sole discretion, and to withdraw an offer at any time prior to the event if circumstances require. We will endeavour to notify applicants of decisions in a timely manner.

05Your Content

By uploading photos, biography text, or other content through the Service, you grant us a non-exclusive, royalty-free licence to use, display, and reproduce that content for the purposes of running the festival (including the public lineup page and promotional materials). You confirm that you own or have the rights to any content you upload, and that it does not infringe third-party rights.

06Intellectual Property

The festival name, logo, and all content on the Service (except user-submitted content) are owned by or licensed to us. You may not reproduce, distribute, or create derivative works without our written permission.

07Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential losses arising from your use of the Service or from attending the festival. Our total liability to you for any claim arising out of these Terms shall not exceed AUD $100. Nothing in these Terms limits liability that cannot be excluded by law, including any consumer guarantees under the Australian Consumer Law.

08Third-Party Services

The Service may link to or integrate with third-party services (for example, ticketing platforms or mapping services). We are not responsible for the content, privacy practices, or terms of those third parties. Your use of third-party services is at your own risk and subject to their respective terms.

09Changes to the Service and Terms

We may modify the Service or these Terms at any time. We will provide reasonable notice of material changes where practicable. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

10Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
